Tam App – Terms & Conditions

Jurisdiction: Registered as an auctions organizer under the Government of Kuwait Ministry of Commerce , operating under Kuwait and GCC Laws and Regulations.

1. Introduction
1.1 By downloading, accessing, or using the TamApp Auctions, you agree to these Terms & Conditions.
1.2 “TamApp” refers to the mobile application operated by [TamApp LLC ], licensed in Kuwait.
1.3 These Terms govern participation in all auctions (Live or Online) and apply to both Buyers and Sellers.

2. Definitions
• Buyer – A registered user participating in auctions to purchase products.
• Seller – A registered and verified user offering products for sale via auctions.
• Buy Now Auction – An auction format where the Seller sets a fixed price for immediate purchase, allowing Buyers to bypass bidding.
• Online + Buy Now Auction – A hybrid auction format where the Seller sets both a Buy Now price and a Base Price for bidding. If a Buyer bids at or above the Buy Now price, the auction ends immediately; otherwise, it continues until the scheduled end time, and the highest bid above the Base Price wins
• Live Auction – A real-time video-streamed auction lasting 15 minutes (extendable once).
• Online Auction – A timed auction without live streaming.
• Base Price – The minimum price at which a Seller agrees to sell an item.

3. Buyer Obligations
3.1 Registration & Verification – Buyers must register, and maintain updated details.
3.2 Bidding Rules
• Bids must meet or exceed the Base Price.
• Confirmed bids are binding and cannot be withdrawn.
• First bid is free; subsequent bids may incur a nominal fee.
3.3 Winning an Auction – A Buyer wins if:
a) Their bid is highest at closing, and
b) Base Price is met or Seller accepts a “Sell Now” offer.
3.4 Payment – Must be made via methods offered by Seller (Payment link, Bank Transfer, or cash on delivery) and in line with the laws and regulations depending on each category.
3.5 Communication – All Buyer–Seller contact must occur within the TamApp to guarantee that TamApp team is aware of the issue at the time of occurrence . Misuse may result in banning from the application.

4. Seller Obligations
4.1 Registration & Verification – Sellers must register and verify ID before listing products.
4.2 Product Listings
• Must be in correct category with accurate description and clear media.
• Shipping method must be specified.
4.3 Auction Conduct –
• Base Price must be set before auction; it may be lowered but not raised.
• Sellers may use “Sell Now” before auction end.
4.4 Delivery Options –
• Self-Ship – Seller arranges delivery directly with Buyer.
• Tam Delivery – Tam coordinates delivery within GCC.
4.5 Refunds & Disputes – Seller must accept returns if the product does not match its description. Fraudulent items will lead to legal action.

5. Platform Rights
5.1 Blocking Users – TamApp may block Buyers/Sellers for abuse, false bids, disruption, or failure to complete transactions.
5.2 Payment Support – TamApp facilitates payment tools but is not the payment processor unless stated.
5.3 Delivery Tracking – Provided through TamApp.

6. Prohibited Conduct
• Use of foul language.
• Bidding without intent to purchase.
• Posting prohibited items.
• Misuse of communication tools.

7. Refunds & Resolution
7.1 Refunds are available if the product:
• Is damaged,
• Differs from its description, or
• Is proven fraudulent.
7.2 Refund Process
• Tam App does not process or hold payments. Refunds must be sought directly from the Seller.
• In the event of a dispute, Buyers must use the in-app Resolution Center to submit a claim.
• TamApp will assist by providing relevant transaction records, communications, and Seller information to both parties and the regulator in the state of kuwait and the GCC.
• If it is determined that a Seller has breached these Terms & Conditions, TamApp reserves the right to take enforcement actions, including suspending or blocking the Seller’s account.

8. Legal Jurisdiction
8.1 TamApp is governed by the laws of Kuwait.
8.2 Disputes will be handled under Kuwait courts, in compliance with Kuwait laws.

TamApp reserves the right to update these Terms. Users will be notified via the applications.
